CreatorTR Collaboration Agreement

Article 1 – Subject and Scope of the Agreement
This Agreement concerns the Creator collaborating with brands (“Brand”) through CreatorTR, carrying out content production activities, and, within this scope, the processing of personal data, the transfer of copyrights, the validity of the digital approval mechanism, and the determination of the parties’ rights and obligations.
Article 2 – Legal Status of the Parties
CreatorTR holds the status of an intermediary service provider under Law No. 6563 on the Regulation of Electronic Commerce. CreatorTR functions as a technical platform that facilitates communication and contract processes between brands and content creators, and is in no way a party to the business relationship between them.
The Creator, on the other hand, is an independent contractor acting in their own name and on their own account; no employee–employer relationship is established with the Platform or the brand.
Article 3 – Obligations of the Creator
- Undertakes that the information declared when registering on the Platform is accurate, current and belongs to them.
- Respects copyright, personality and trademark rights in collaborations carried out through the Platform.
- Acts in accordance with the content standards set by CreatorTR, advertising ethics principles and applicable legislation.
- Does not establish a direct commercial relationship without CreatorTR’s written permission in collaboration processes conducted with brands or third parties.
- Declares that all visual, video, audio or text-based content uploaded to the Platform is original and does not infringe the rights of third parties.
Article 4 – Copyright and Usage Authorization
The Creator agrees that, within each collaboration carried out through the Platform, they transfer to the Brand the economic rights (within the scope of Articles 21–25 of the Law on Intellectual and Artistic Works, FSEK) over the content they produce, on an unlimited, irrevocable and geographically unrestricted basis. The Brand may use this content without any restriction in digital media, on social media channels, in print press, in television advertisements or in digital campaign materials.
The Creator accepts in advance that they may not subsequently claim copyright, additional fees or attribution notices over the said content. CreatorTR has the right to reuse content transferred to the brand on a limited basis for the purposes of platform promotion and building a sample work portfolio.
Article 5 – Pricing, Commission and Payment
CreatorTR is a platform that provides digital intermediation, representation, referral and business development services between content creators (“Creator”) and brands (“Brand”). A Creator who registers on the CreatorTR platform and approves this agreement electronically acknowledges that they are part of the CreatorTR ecosystem and, within this scope, accepts, declares and undertakes CreatorTR’s right to commission.
The Creator is obliged to pay CreatorTR a percentage commission not only on collaborations established through CreatorTR, but also on the amounts they obtain from all commercial collaborations carried out, directly or indirectly, with third-party brands, agencies, institutions or individuals without any referral, reference, intermediation or platform use by CreatorTR.
The right to commission applies regardless of whether the collaboration was carried out inside or outside the CreatorTR platform, whether CreatorTR actually took part in the relevant collaboration, whether the collaboration was established at the Creator’s own initiative, or whether the collaboration process was conducted through a different intermediary. The Creator unconditionally accepts CreatorTR’s right to commission in respect of all commercial collaborations obtained throughout the duration of their contractual relationship with CreatorTR.
The commission rate is determined unilaterally by CreatorTR, may be updated, and may additionally be notified in writing or electronically. Upon request, CreatorTR may serve as a secure payment intermediary and may collect the commission amount directly from the relevant collaboration income.
CreatorTR is not responsible for the principal performance of the collaborations between the Creator and the Brand, for payment obligations, for content performance or for commercial results, and reserves all commission, receivables and other financial rights arising under this agreement.
Article 6 – Data Processing and Protection of Personal Data
CreatorTR holds the status of data controller under Law No. 6698 on the Protection of Personal Data (“KVKK”). The Creator’s personal data is processed only for the purposes of service provision, security, identity verification, invoicing and communication.
By approving this agreement, the Creator gives explicit consent to the processing of their personal data by CreatorTR and its business partners in accordance with the Data Protection Policy and the KVKK Disclosure Notice, and to its transfer to domestic and, where necessary, foreign servers.
Article 7 – Electronic Approval and Evidentiary Value
This agreement takes effect upon being approved electronically, without a physical signature. The Creator’s completing the form and clicking the “Approve the Agreement” button constitutes a valid declaration of intent that fulfils the written form requirement pursuant to Electronic Signature Law No. 5070 and Article 14 of the Turkish Code of Obligations.
The parties accept that records created electronically (forms, e-mails, transaction logs) constitute conclusive evidence and are binding within the meaning of Article 193 of the Code of Civil Procedure No. 6100.
Article 8 – Disclaimer and Platform Authorities
CreatorTR cannot be held responsible for briefs, payments, feedback or content revisions provided by brands. The Platform undertakes only a communication and referral role. CreatorTR has the authority to suspend the account of users acting contrary to the platform rules, to stop a collaboration or to close the account.
Article 9 – Termination and Term
This agreement takes effect on the date it is approved electronically by the Creator and remains in force until one of the parties gives notice of termination. CreatorTR has the right to terminate this agreement unilaterally, without granting any notice period.
Article 10 – Governing Law and Jurisdiction
This Agreement is governed by Turkish Law. In any dispute that may arise between the parties, the Istanbul (Anatolian) Courts and Enforcement Offices have exclusive jurisdiction.
Article 11 – Entry into Force
All articles of this Agreement have been read, understood and approved electronically by the parties. With this approval, the Creator accepts and undertakes to fulfil all obligations set out in this text and to transfer the necessary authorizations to CreatorTR.
